1. General Medical Disclaimer
All materials, views, and information provided on truenorthot.com are intended for informational and educational purposes only. They do not constitute and cannot establish a patient/therapist relationship without a formal agreement, including a signed informed consent, between you and True North Occupational Therapy, LLC.
This website is not a substitute for professional medical or therapeutic advice. Users are encouraged to seek individualized counseling or medical assistance for their specific needs. True North Occupational Therapy, LLC, is not liable for any damages resulting from reliance on the information provided on this website. 2. Privacy & Data Protection (GDPR Compliant)
True North Occupational Therapy, LLC, is committed to protecting your privacy. Because our practitioner is established in Sweden (European Union) while serving clients in the United States, our data processing complies with the General Data Protection Regulation (GDPR) and relevant US privacy standards (HIPAA).
Data Controller: The controller for your data is Marissa Marchioni, operating as an enskild firma in Sweden and as True North Occupational Therapy, LLC, in the US.
Information Collection: We collect only the information you voluntarily provide through website subscriptions, contact forms, or direct contact.
Legal Basis for Processing: We process your data based on Consent (for inquiries/newsletters) and Contractual Necessity (for clients).
International Data Transfers: By using this site or contacting us, you acknowledge that your data will be processed by a practitioner in the EU and stored on secure, HIPAA-compliant servers in the United States (e.g., SimplePractice, RingRx). For data transfers from the EU to the US, we utilize a combination of the EU-U.S. Data Privacy Framework (for services like Google Workspace) and Standard Contractual Clauses (for our clinical and communication platforms) to ensure a level of protection equivalent to the GDPR.
Third-Party Links: Links to third-party sites are provided for your convenience. They have their own privacy policies; we are not responsible for their content or data practices.
Cookies: We do not currently use tracking or marketing cookies on this website. Should this change, a consent banner will be provided in accordance with EU law.
3. Your Rights
Under the GDPR, you have the right to access, rectify, or request the erasure of your personal data.
Withdrawal of Consent: You have the right to withdraw your consent for specific processing activities—such as the use of AI tools—at any time without affecting your right to continue therapy.
Inquiries: If you have contacted us but are not a clinical client, we will delete your data upon request.
Clinical Records: Please note that while you may request the deletion of non-clinical data, the "Right to Erasure" is limited by our legal and ethical obligations to maintain clinical records for a minimum of 10 years as required by law.
4. Confidentiality & Mandatory Reporting
Although using this website does not create a patient/therapist relationship, we are legally and ethically obligated to report suspected child or elder abuse. In such cases, your disclosures will not be confidential and will be shared with appropriate authorities. We are also required by law to disclose information in instances of threats of self-harm or harm to others, abuse of dependent individuals, and receipt of lawful subpoenas.
5. Optional AI Tools & Explicit Consent
In the interest of transparency, clinical clients should be aware that I offer the use of AI-assisted transcription tools (such as SimplePractice Note Taker) to enhance clinical documentation.
Strictly Optional: The use of AI is not a requirement for receiving services.
Explicit Opt-In: AI tools are only activated for clients who provide explicit, written consent during the intake process.
Data Minimization: If consent is provided, audio recordings are processed into a text draft and then immediately and permanently deleted. I review and edit all AI-generated drafts to ensure clinical accuracy.
No Consent, No AI: If you do not provide consent, or if you choose to withdraw it, I will utilize traditional manual note-taking methods for your sessions.
6. Affiliate & Non-Endorsement Disclosure
True North Occupational Therapy, LLC, does not engage in marketing partnerships or affiliate programs. Any product recommendations are based on potential clinical benefit and are not exhaustive endorsements. Users assume all risk associated with relying on third-party links, materials, or products.
7. Indemnification & Liability
By using this website, you agree to indemnify and hold harmless True North Occupational Therapy, LLC, from any claims arising from your use of the website or reliance on its content. You acknowledge that the information provided is not medical, legal, financial, or actuarial advice. This agreement is governed by the laws of the State of Georgia, USA, without prejudice to mandatory consumer protections afforded to residents of the European Economic Area.
